The Office of Public Prosecutions (OPP) is an independent statutory authority responsible for preparing and conducting criminal prosecutions in Victoria on behalf of the Director of Public Prosecutions (DPP). Matters prosecuted by the DPP and the OPP involve serious crimes or matters that are of significance to the fair and effective operation of the Victorian criminal justice system.The OPP consists of the Solicitor for Public Prosecutions and a staff of approximately 400 providing legal and corporate support to the DPP, the Chief Crown Prosecutor and Crown Prosecutors in the exercise of their independent roles in the criminal justice system.Senior Solicitor – Proceeds of Crime (Ongoing, Full-Time)The Office of Public Prosecutions (OPP) has an exciting opportunity for an experienced Solicitor to join our Proceeds of Crime division.The role is responsible, under minimal supervision, for the preparation of a wide variety of Confiscation Act litigation in the Melbourne Supreme and County Courts and instructing Counsel appearing for the DPP. The incumbent will be required to appear routinely in the Confiscation List of the County Court to make applications for restraining and other orders, and other pre-trial proceedings on behalf of the DPP. The incumbent will also have the opportunity to prepare cases for appeals to the Supreme Court.About the Role Prepare the more complex conviction-based confiscation matters and Civil Forfeiture and Unexplained Wealth applications and appealsPrepare and/or instruct Counsel in the conduct of more complex confiscation litigation and other hearings.To appear in applications pursuant to the Confiscation Act 1997 and other pre-trial proceedings as required. As our ideal candidate you will: Extensive knowledge of civil rules and procedure, and working knowledge of criminal law knowledge (desirable)Demonstrated competence and experience in the preparation and conduct of commercial and/or civil litigation, and familiarity with proceedings under other relevant legislation such as the Confiscation Act.Demonstrated ability to perform and provide advice on high-level complex legal and policy issues.
